Products

HYQS jewelry is created and handcrafted, in small series, by Sophie This artisanal production represents for us a free creation, exercised from noble materials, such as 925 silver, 24-carat gold plated and precious stones.

Due to this process of creation, the jewels can sometimes present irregularities. Each jewel is the subject of special attention and quality control at each stage of manufacture in order to guarantee its quality.

Our product offers and prices are valid as long as they are visible on the Site. We reserve the right to change the Products offered on the Site at any time In order to ensure a better quality of service and availability of our Products for all customers.

The Products sold on the Site are presented, photographed and described as faithfully and accurately as possible. We strive to ensure that the photos are faithful to the original Products. However, variations, errors or omissions are possible. Similarly, depending on the Internet browser or your computer equipment, and due in particular to technical limitations in color rendering, the colors of the items may not correspond to the actual colors In this case, we cannot be held responsible for these non-substantial variations, errors or omissions in the photographs or graphic representations of the Products appearing on the Site. Price

The prices of the Products are indicated in Euros, all taxes included, excluding delivery costs.

The delivery costs are indicated to the Customer before placing his order.

We may modify the prices of the Products at any time and without notice. The Products are invoiced on the basis of the prices displayed on the Site at the time of placing your order, subject to the availability of the Products.

All orders are payable in Euros and must be paid immediately when placing your order.

For any order shipped to a country outside the European Union, customs duties, other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of Sophie Ciccone – HYQS. They are the sole responsibility of the Customer and are their full responsibility both in terms of declarations and payments to the competent authorities and/or bodies in your country.

Payment

Several means of payment, offering maximum security guarantees, are available to the customer:

The price is payable in cash, in full, on the day of the order. In the event of split deliveries, only the products shipped are debited.

Delivery

The products are delivered to the delivery address indicated during the ordering process, within the time indicated on the order validation page.

In the event of a delay in shipment, an email will be sent to you to inform you of any consequences on the delivery time indicated to you.

In the event of deliveries by a carrier, Sophie Ciccone – HYQS cannot be held responsible for late delivery due exclusively to the unavailability of the customer after several appointment proposals.

The delivery costs are indicated to the Customer before the final validation of his order.

Delivery and collection times

Our products are available in stock but also often to order. As some of our jewelry is made to order, delays may still occur and you will be notified as soon as possible.

The Products ordered will be delivered within a normal period of 6 working days from the confirmation of the order to the Customer by e-mail and a maximum of 20 calendar days from the registration of the Order, subject to full payment of the price.

Delivery problem

In accordance with legal provisions, in the event of non-compliance with the delivery time, you have the option of canceling the order under the terms and conditions defined in Article L 138-2 of the Consumer Code. If in the meantime you receive the product, we will reimburse it and the shipping costs under the conditions of article L 138-3 of the Consumer Code.

Right and period of withdrawal

In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify reasons or to pay a penalty.

Returns must be made in their original condition and complete (packaging, accessories). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal.

You will be responsible for the direct cost of returning the Product.

In the event of exercise of the right of withdrawal, Sophie Ciccone – HYQS will refund the sums paid, within 14 days of notification of your request and via the same means of payment as that used when ordering.

If this period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the first following working day.

Restriction to the right of withdrawal

In accordance with article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for orders of Products made according to the Customer’s specifications or personalized Products (namely, for example, jewelry with a personal choice of stones, an engraving or which have undergone a modification in size).

Legal guarantees

The Products sold on the Site are subject to the conditions of legal guarantees provided for by articles L217-4 to L217-14 of the Consumer Code as well as by articles 1641 to 1648 of the Civil Code, to the exclusion of all other guarantees.

• Legal guarantee of conformity

Sophie Ciccone – HYQS undertakes to deliver to the Customer a Product that complies with the contract and is free from defects of conformity when the said Product is delivered, in the sense that the Product will be suitable for the use usually expected of a similar good and that it will present the characteristics presented during the sale. Sophie Ciccone – HYQS is also liable for lack of conformity resulting from the packaging, the assembly instructions when this has been charged to it by the contract or has been carried out under its responsibility.

This warranty will only come into play on the condition that the Customer requests it within 30 days of delivery of the Product.

The Customer may choose between repairing and replacing the Product unless one of these choices entails a manifestly disproportionate cost for Sophie Ciccone. If the repair or replacement of the Product is impossible, the Customer may be reimbursed the price paid and return the Product or keep the Product and be reimbursed part of the price. The return, replacement or reimbursement of the Product will take place at no cost to the Customer and does not preclude the possible allocation of damages in the event that the Customer is entitled to them. The resolution of the sale cannot be pronounced if the lack of conformity is minor.

The legal guarantee of conformity applies independently of the commercial guarantee described below.

Return of Products in the event of withdrawal, non-compliance or hidden defect

The Products must be returned in their original condition and packaging (the original box and if possible the shipping carton), accompanied by their purchase invoice or a copy in the event of a partial return. If any packaging is missing, we reserve the right to charge you four (4) euros.

The Customer’s liability may be incurred in the event of depreciation of the Products resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of these Products.

We advise you to take out the insurance offered by your carrier. We will not be liable for any loss, mis-delivery or late delivery of any Product you wish to return, as the risk of the transportation you choose and initiate rests with you alone.

Responsibility

The products offered comply with the French legislation in force. Sophie Ciccone – HYQS cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered.
